Such client working papers or deliverables may be branded with the client's branding and logo but MAY NOT be branded with your own corporate branding and logo.

Do I need to include any specific clauses in the consulting contract with the client?

For your own protection we recommend that you include a clause which reflects the fact that you may use pre-existing intellectual property such as methodologies, tools and templates developed and owned by third parties as part of the project, with attribution and citation of such intellectual property content, and that ownership and copyright of this pre-existing intellectual property remains with the third party content provider at all times.

We strongly recommend that you obtain legal assistance from a qualified lawyer in your local jurisdiction in drafting the appropriate clauses.

If, for example, I provide consulting services to a client and use one of the Cyber Leadership Institute or Info-Tech developed policy templates to develop a policy for the client:

Can I put a client logo on this document?

Yes, because it now becomes a client internal document.

Can I put my own consulting organization's logo on the policy document?

No, this is not permitted.

Do I need to include any citation / attribution in this policy document?

No this is not required.

If I used a tool (e.g. an Excel spreadsheet or Word template) as part of a consulting service for a client and produced a deliverable based on the tool which now contains actual information about the client's business:

Can I put a client logo on this completed deliverable?

Yes, because it now becomes a client internal document.

Can I put my own consulting organization's logo on the final completed deliverable?

No, this is not permitted.

Can I include any reference to my consulting organization in the completed deliverable, e.g. a note in the footer saying “Prepared by ACME Consulting”, or a note in the Version Control panel at the front saying “Version 1: Prepared by ACME Consulting"?

Yes, as it recognizes the work the consulting organization has done and the IP they have developed as part of the consulting project.

Do I need to include any citation / attribution in the completed deliverable?

Yes, appropriate citation and copyright attribution is required, for example either:

  • Retain the full copyright page, or
  • Include a note on the deliverable saying “Version x: Prepared by ACME Consulting using a methodology and tools developed by the Cyber Leadership Institute / Info-Tech Research Group”, or
  • A citation in a covering report for example “The attached assessment has been prepared for CLIENT using a methodology and tools developed by the Cyber Leadership Institute / Info-Tech Research Group”.
